Vi vet ju sedan tidigare att det kan vara känsligt det här med begagnade spel, fråga bara hur Microsoft mådde efter att dem visat upp Xbox One. Kanske den bästa presskonferansen för ett annat bolag, fråga Sony. Men den här gången är det dock Polygon som har rapporterat att Bethesda blivit upprörda över att en kille vid namn Ryan Hupp har försökt att sälja sitt oöppnade The Evil Within 2. Detta bemötte Bethesda med ett härligt mejl till Hupp:
Unless you remove all Bethesda products, from your storefront, stop selling any and all Bethesda products immediately and identify all sources of Bethesda products you are selling, we intend to file a lawsuit against you
Det här är givetvis bara en liten del av mejlet som han delade med sig till Polygon. Men det är inte över där. Utan Hupp stod på sig och poängterade att detta är under skydd av First-sale doctrine som gäller film, musik och spel, vilket gör att du kan sälja vidare föremål så länge du inte har ändrat på något. Och eftersom The Evil Within 2 var oöppnat, så borde ju detta gällas, givetvis. Det är absolut inte över, då Polygon blev kontaktade av Bethesda med följande:
Bethesda does not and will not block the sale of pre-owned games. The issue in this case is that the seller offered a pre-owned game as "new" on the Amazon Marketplace.
We do not allow non-authorized resellers to represent what they sell as "new" because we can't verify that the game hasn't been opened and repackaged. This is how we help protect buyers from fraud and ensure our customers always receive authentic new product, with all enclosed materials and warranty intact.
In this case, if the game had been listed as "Pre-Owned," this would not have been an issue.
Vi kan förstå Bethesda att de vill skydda sina kunder, och det Hubbs valde att ta bort spelet från Amazon men poängterar också att det här har gått till överdrift:
I understand the legal arguments Bethesda are relying on, and accept that they have some legitimate interest in determining how their products are sold at retail, but threatening individual customers with lawsuits for selling games they own is a massive overreach.
